We all know Highway 11 can be a dangerous road, but some drivers make it worse.
OPP reported that a 45-year-old transport driver from Brampton was charged with 24 offences in less than 24 hours.
The charges, laid by OPP near Timmins, included three different stops between 10 a.m. on Jan. 28 and 8 a.m. on the 29th.
Police say charges include careless driving and driving over hours.
Careless driving is defined as driving a vehicle on a highway without due care and attention or without reasonable consideration for other people using the highway.
In Canada, a commercial truck driver must stop driving after 13 hours of driving time from the end of the most recent period of 8 consecutive off-duty hours. 14 hours of on-duty time from the end of the most recent 8 consecutive off-duty hours. 70 hours over 7 consecutive days, or 120 hours over 14 consecutive days.
Court-imposed penalties for careless driving can include a fine in the range of $400 to $2,000, plus victim fine surcharge and court costs; an Ontario Driver's Licence Suspension not more than two years; and/or. a custodial jail sentence not exceeding six months.
The saga started on January 28 at 10:47 a.m., when South Porcupine OPP responded to a traffic complaint of a transport swerving all over the road. Police located it on Highway 11 near Ramore, and the driver was charged with four Highway Traffic Act offences.
The next day at 12:32 am, OPP conducted a traffic stop on that same truck and driver, on Highway 11 near Val Cote. The driver was charged with four additional HTA offences.
That same day at 7:39 am, the OPP responded to a traffic complaint about that same driver, on Highway 11 near Smooth Rock Falls.
.As a result of the investigation, the driver is charged with 24 total offences:
- Three counts of the driver failing to surrender licence
- Two counts of failing to surrender an inspection schedule
- Two counts of failing to enter a defect in the daily inspection report
- Two counts of Improperly driving a commercial motor vehicle with a minor defect in it or in a drawn vehicle
- Three counts of careless driving
- Two counts of unnecessary slow driving
- Two counts of failing to maintain a daily log
- Fail to surrender a daily log
- Driver in possession of more than one daily log
- Fail to take 10 hours off in a day
- Exceed 13 hours of driving time without 8 hours off
- Drive after 14 hours on duty without 8 hours off
- Drive after 16 hours since the last break without 8 hours off
- Fail to keep a record of duty status
- Fail to manually input information into ELD
- Enter inaccurate information in a record
The owner of the transport from Edmonton, Alberta, was also charged with the following five offences:
- Fail to surrender the inspection schedule
- Two counts of failure to enter defects in the daily inspection report
- Improperly driving a commercial motor vehicle with a minor defect in it or in a drawn vehicle
- Request, require, or allow driver not to comply with section 18
The vehicle was taken out of service in Cochrane. The OPP encourages drivers to operate within their allotted hours. Driving while fatigued affects your judgment, perception, and reaction time.
