Pair convicted of sexual assault arrested after breaching release conditions

David Case and Celine Loyer were out on bail while the appeal of their convictions and sentencing works its way through the court

Celine Loyer, a former sprinter, and David Case, her former track coach, were convicted in March 2020 of drugging and sexually assaulting a 19-year-old in 2011.

While out on bail to appeal their sexual assault convictions and sentencing, David Case and Celine Loyer were arrested April 11 for breaching conditions of that release.

Greater Sudbury Police said Case and Loyer were arrested April 11 and charged for failing to comply with their release order in relation to an incident that occurred on March 23 that put them both in breach of their conditions.

Case and Loyer were convicted in March 2020 for their roles in sexually assaulting an unconscious 19-year-old woman at Case's Sudbury home in 2011. Loyer was convicted of sexual assault, while Case was convicted of sexual assault by aiding and abetting. 

They were both sentenced to 16 months in jail in February 2021, but were both granted bail, sparing them from jail as they appealed both the conviction and sentencing.

Bail conditions included Loyer and Case were not to communicate directly or indirectly except for employment purposes or through or in the presence of counsel.

GSPS said they attended a local business together on March 23.

When Justice Patricia Hennessy handed down the sentence, she told the pair it was in their best interest if they went their separate ways.

A return date of May 4 has been set.

An email from Sudbury.com to Case’s lawyer has not yet been answered.

Sudbury.com learned recently that the appeal process was delayed as Case’s lawyer, Nicholas Xynnis, was dealing with personal health matters.

Case and Loyer have been denied legal aid to help pay for their appeals, Xynnis told Sudbury.com. They are in the process of appealing that decision, as well.

Case was also convicted in January 2021 of another sexual assault on a former student-athlete who he later married in secret. He was also appealing that conviction. He was sentenced to 45 months in prison, but was given bail to allow him to appeal.
