The trial of four men charged with committing a home invasion two years ago was delayed for a full day when Justice Frank Caputo was informed by a defence lawyer she overheard a conversation about the case between two jurors during a break in proceedings Monday.

Caputo talked to the two jurors and they confirmed they had made certain statements without hearing any evidence. Caputo said he had no choice but to dismiss them from the jury.

It took another hour to select the final two jurors and to ensure there were no further delays. Caputo asked two alternate jurors be selected, which is very rare.

It?s alleged four young men broke into a residence the evening of Sept. 7, 2003 and roughed up the homeowner during a violent home invasion.
