Drunk driving suspect, passenger get in fist fight

A 32-year-old Lively man has been charged with impaired driving-related offences after an incident in which he allegedly drove “erratically” in Atikameksheng First Nation, and then got in a fist fight with the passenger in his car.

The Nipissing West OPP responded to a report of an assault on Maani Street in Atikameksheng First Nation (which is in the Walden area) at 5:05 a.m. Sept. 23.

Their investigation revealed that the driver and his passenger were travelling to Atikameksheng First Nation, when an argument ensued regarding the manner in which the driver was operating the vehicle. 

The driver continued to drive erratically until the vehicle skidded across the road and came to a sudden stop. The driver and passenger subsequently engaged in a fist fight on the side of the road. 

OPP said further investigation revealed the driver had consumed alcohol and was arrested.  

The man has been charged with:

  • Operation While Impaired - Alcohol and Drugs, contrary to section 320.14(1)(a) of the Criminal Code (CC);
  • Operation While Impaired - Blood Alcohol Concentration (80 Plus), contrary to section 320.14(1)(b) of the CC;
  • Operation While Prohibited Under the Criminal Code, contrary to section 320.18(1)(a) of the CC; and
  • Driving While Under Suspension - while suspended under HTA section 41/42, contrary to section 53(1.1) of the Highway Traffic Act (HTA).

The accused was issued a 90-day Administrative Driver's Licence Suspension (ADLS) and the vehicle was impounded for 45 days.

The investigation is continuing.  

This charge marks the 47th driver charged under Criminal Impaired Driving Laws in the Nipissing West Detachment area in 2020.
