Hamilton man facing impaired charges after rollover in French River

A 35-year-old Hamilton man is facing impaired driving-related charges after a single-vehicle roll-over in the French River area at midnight Sept. 19.

The roll-over took place on Highway 607. Police say their investigation revealed the driver had consumed alcohol. A breath demand was issued, and the driver refused to comply and was subsequently arrested.   

The driver sustained minor injuries in the crash. He was charged with:

  • Failure or Refusal to Comply with Demand, contrary to section 320.15(1) of the Criminal Code (CC);
  • Operation While Impaired - alcohol and drugs, contrary to section 320.14(1)(a) of the CC;
  • Dangerous Operation, contrary to section 320.13(1) of the CC;
  • Obstruct Peace Officer, contrary to section 129(a) of the CC;
  • Driving While Under Suspension, contrary to section 53(1) of the CC; and
  • Driving Motor Vehicle with Liquor Readily Available, contrary to section 32(1) of the CC.

The accused was released on an Undertaking, and is scheduled to appear in Sudbury court Oct. 14.

He was issued a 90-day Administrative Driver's Licence Suspension (ADLS) and the vehicle was impounded for seven days.   

This charge marks the 44th driver charged under Criminal Impaired Driving Laws in the Nipissing West Detachment area in 2020.
