Man could get dangerous offender status

Kenneth ?Kenny? MacDonald just completed a 60-day psychological assessment at a clinic in Toronto. Court heard Tuesday the psychiatrist who conducted the assessment has yet to complete a report.

MacDonald was ordered remanded in custody until assistant Crown attorney Fran Howe and defence counsel Andrew Buttazzoni can read it.

When MacDonald returns to court, Howe will announce whether the Crown will be seeking a hearing to have MacDonald declared a dangerous or long-term offender. If the report is favourable towards MacDonald, the Crown is expected to proceed with sentencing in relation to an assault MacDonald was found guilty of committing last summer.

Howe would have to receive permission from the attorney general?s office to go ahead with the dangerous or long-term offender application.

If a judge were to deem MacDonald a dangerous offender, he could be locked up indefinitely. If a judge were to deem MacDonald a long-term offender, authorities would have special powers to watch him closely when he?s released from custody.

He was convicted in February for assaulting another man in a hotel washroom last summer. His record includes almost a dozen convictions for assault, assault causing bodily harm, assault with a weapon and one conviction for armed robbery.
