Police say Temiskaming Shores man had open liquor in vehicle while driving on Sudbury highway

A Temiskaming Shores man who allegedly had open liquor in his vehicle while driving on Highway 17 in Greater Sudbury May 13 has been charged with impaired driving offences.

The Nipissing West OPP say at around 2:45 p.m. Thursday, they stopped the man’s vehicle for driving 37 kilometres/hour over the posted speed limit.

Officers determined that the driver had signs of impairment, and he was arrested and transported to the Sudbury OPP detachment for further testing.

Open liquor was located in the front console.

The 31-year-old man was charged with:

  • Operation while impaired - alcohol and drugs, contrary to section 320.14(1)(a) of the Criminal Code (CC)
  • Operation while impaired - blood alcohol concentration (80 plus), contrary to section 320.14(1)(b) of the CC
  • Driving motor vehicle with open container of liquor, contrary to section 32(1) of the Liquor Licence Act.
  • Speeding 1 - 49 Km/h over posted limit, contrary to section 128 of the Highway Traffic Act (HTA)
  • Drive - hand-held communication device, contrary to section 78.1(1) of the HTA.

The accused was released on an Appearance Notice and is scheduled to appear in Sudbury court May 26.

The accused was issued a 90-day Administrative Driver's Licence Suspension and the vehicle was impounded for 45 days.

This incident marks the 22nd driver charged under the criminal impaired driving laws in the Nipissing West Detachment area in 2021.
