ATVs cause trouble for CN trains

Police crews with CN are reporting an increase in ATV traffic on and along the CN high speed, mainline tracks on and along the spur tracks running throughout Sudbury, Hanmer and Capreol.

CN's engineering department is experiencing damage to the track bed caused by the big tires on ATV’s removing the crushed stone as they ride on and alongside the tracks.

This practice by ATV enthusiasts is not only prohibited by the Trespass to Property Act, it is also dangerous for CN trains and their crews. This type of behaviour is also dangerous for ATV operators as they cannot hear the approach of trains at high speeds.

Greater Sudbury Police in partnership with the CN Police will be conducting enforcement throughout that area to ensure the safety of all trains within the jurisdiction.  

Anyone caught on CN property stands to be charged with trespassing, mischief under the criminal code or common nuisance under the criminal code.

Common nuisance is committed when a person endangers the lives, safety or health of the public or causes physical injury to any person. By causing damage to the track beds persons are endangering the lives and safety of train crews. This offence carries a penalty of imprisonment for a term not exceeding two years in prison. Anyone found guilty of trespassing contrary to the Railway Safety Act, can be fined up to $5,000.
