A Sudbury man found passed out behind the wheel near a drive-through window this past summer was sentenced to 30 days in jail as this was his third drunk driving conviction.

Richard Blais, 50, pleaded guilty to impaired driving Wednesday at the Sudbury courthouse.

Court heard an employee at a fast food restaurant notice strong signs of intoxication when Blais pulled up to a drive-through window in the early morning hours of July 18.

Even though Blais pleaded with the woman not to contact police, she did place a call and when police arrived, they found Blais passed out behind the wheel.

He was arrested and two breathalyser tests revealed he had almost three times the legal amount of alcohol in his system allowed to drive in Canada.

Court heard Blais had a previous conviction for impaired driving back in 1988 and another one in 1991.

Because there was a more than 15-year gap between convictions, the Crown agreed to a 30-day jail sentence to be served on weekends so Blais can keep his job at a local paving company, said assistant Crown attorney Andrew Slater.

Before sentence was passed, Bourgeois said his employer was willing to keep him on even though he did a lot of driving on the job and will find him other work.

Justice William Fitzgerald agreed to the 30-day sentence to be served on weekends and suspended Blais' driver's license for 18 months.

Blais will start serving his sentence this weekend at the Sudbury District Jail.
