Former union boss Rick Briggs is going to have to wait a little longer to find out whether or not he?s been found guilty of assault for allegedly spitting in the face of a security guard hired by Falconbridge Ltd. during a bitter labour dispute.

Justice Guy Mahaffy was set to render his decision Monday, but agreed to another delay after it was revealed Briggs? lawyer couldn?t be in court due to a family matter.

A new date for a decision will be set next Wednesday.

Briggs, the former president of Local 598 of the Mine Mill/CAW, was charged in the fall of 2000 with assault.

A security guard from Accu-Fax Security, the firm hired by Falconbridge Ltd. to protect company property during the bitter seven-month strike between the nickel giant and Local 598, said Briggs spit in his face during a picket line incident Oct. 31, 2000.

For a variety of reasons, Briggs? trial was delayed several times since it started last September.
