The man who forced the evacuation of his apartment building and Greater Sudbury Police bomb squad to be called was spared a jail sentence Wednesday.

However, Philippe Cadieux, 26, will have to seek counselling for anger management and must agree to undergo a mental health assessment on top of the four months of house arrest imposed against him by Justice William Fitzgerald.

Court heard on Jan. 25, Cadieux threatened to blow up the College Street apartment building where he lived. Cadieux had been arguing with his mother, who is his landlord. He hooked up a crude series of wires to the door of an apartment.

After police were called, tenants were evicted as a precautionary measure and the bomb squad was called in.

It quickly became evident the wiring and threat did not pose a danger, but obviously many people were concerned with what appeared to be a serious situation, said assistant Crown attorney Alex Kurke.

Defence counsel Alex Toffoli said the Crown had originally been looking at a ?short, sharp jail sentence? of 30 days to bring home to Cadieux the seriousness of this threat. However, after reviewing all the evidence, a joint submission for an extended conditional sentence to be served in the community with many conditions would be more appropriate.

During the four months of house arrest, Cadieux can?t leave his residence except for four hours each afternoon or to attend school, medical emergencies or other reasons approved by his probation officer.

He must also attend an anger management course, starting next week, and has agreed to undergo an assessment by the Canadian Mental Health Association, said Toffoli.

Fitzgerald also ordered Cadieux be prohibited from owning or possessing weapons for three years. He cannot have any contact with his mother during
the conditional sentence.

Cadieux was also placed on probation for an additional 12 months, where he must continue counseling recommended by his probation officer.
