City, Interpaving make first appearance in pedestrian death case

Both charged by Ministry of Labour in death of Cécile Paquette. Next appearance is Nov. 30

After being charged in the 2015 incident that left a downtown pedestrian dead, the City of Greater Sudbury and Interpaving Limited made their first appearances at provincial offences court Friday morning.

The City of Greater Sudbury and Interpaving Limited will return to court Nov. 30.

Both were represented by their lawyers for their first appearance at provincial offences court Friday morning.

The Ontario Ministry of Labour laid charges against the City of Greater Sudbury and Interpaving Ltd. in the death of 58-year-old Cécile Paquette in September, 2015. 

She was killed last year at the corner of Elgin and Beech streets. Her family is suing the city, Interpaving Ltd. and the driver of a road grader for $2 million. The lawsuit will return to court Dec. 9 to set a pretrial date.

Following Paquette's death, Interpaving was barred from bidding on road work contracts in the city of Greater Sudbury, although it can bid on sub-contracts.

After being charged in September, the city vowed it would fight the charges.

"The City of Greater Sudbury will be vigorously defending the charges laid by the Ministry of Labour stemming from the Sept. 30, 2015 incident," the city said in a previous statement.

Interpaving is charged with not providing signallers for the grader operator, not erecting a 1.8-metre "sturdy fence" to separate the public from the construction site, and not implementing a traffic protection plan.

The city faces the same three offences, as well as not ensuring that its contractor, Interpaving, was following those three sections of Ontario's Occupational Health and Safety Act.

The city is also facing an additional charge of not ensuring that all "workers and employers" were following provincial safety laws in general.
