A retired Judge of the Superior Court of Justice, Chester Misener, will look at each case to determine eligibility and compensation amount, according to a press release from the province.

"The flawed work of Dr. Charles Smith has deeply affected the lives of many people in Ontario," Chris Bentley, the Attorney General, said in the release. "Today we are moving forward with payments to recognize the impact of that experience."

Smith, the former head of pediatric forensic pathology at the Hospital for Sick Children in Ontario, received a reprimand from the Ontario College of Physicians and Surgeons in regards to three suspicious death cases. He was later removed from performing autopsies.

In 2008, the chief forensic pathologist for Ontario began a public inquiry into 220 cases to determine if anyone was wrongfully convicted.
