Drunk driver to spend weekends in jail

A repeat drunk driver who hit a bus while his driver's licence was under suspension and then tried to leave the scene of the accident was given a 45-day jail sentence Wednesday.

Jeremy Marion, 32, who had four previous drunk driving convictions, pleaded guilty to impaired operation of a motor vehicle for an incident earlier this year.

Court heard Marion clipped a bus, which sent his vehicle veering into a concrete abutment, spinning the vehicle out of control. Marion did not have a driver's license due to a previous drunk driving conviction from 2004.

Assistant Crown attorney Susan Stothart said a witness saw Marion try to climb out of the passenger door. When the witness asked Marion if he was alright, Marion replied he didn't "give a shit."

Marion then tried to run away from the scene, but was caught by the  witness and held until police arrived.

Police found alcohol inside the vehicle and noticed numerous signs of impairment and two breathalyser tests revealed Marion was over the legal limit.

Defence counsel Claude MacMillan said Marion is self-employed and involved in a common-law relationship. A pre-trial judge agreed a 45-day jail sentence, to be served on weekends, would be an appropriate sentence.

Stothart noted this is Marion's fifth drunk driving conviction in the past 14 years.

Justice Guy Mahaffy agreed to the joint submission and ordered Marion to serve 45 days in jail on weekends and suspended his driver's licence for another two years.
