Wal-Mart was fined $60,000 last week for a violation under the Occupational Health and Safety Act after an employee suffered a serious ankle injury at the New Sudbury Shopping Centre store.

On Jan. 9, 2004, a maintenance worker was using a mobile ladder stand to access a ceiling-mounted, gas-fired heater when the stand moved causing the worker to fall nine feet onto a concrete floor. The worker suffered a broken ankle and torn tendons and ligaments.

A Ministry of Labour investigation found the stand was not in good condition and should not have been used.

Wal-Mart Canada pleaded guilty, as an employer, to failing to ensure the ladder stand was maintained in good working condition.

The fine was imposed in provincial offences court in Sudbury.

On top of the $60,000 fine, Wal-Mart must also pay a 25 percent surcharge as required under the Provincial Offences Act. The surcharge is put into a special provincial government fund to assist victims of crime.
