Youth sentenced in Patrick Herard case

A 17-year-old Chelmsford youth who hit and killed a teenager while involved in a street race last spring was sentenced to six months of house arrest. His driver's licence has been suspended for 10 years.

A 17-year-old Chelmsford youth who hit and killed a teenager while involved in a street race last spring was sentenced to six months of house arrest.

His driver's licence has been suspended for 10 years.

The accused, who can't be named under provisions of the Youth Criminal Justice Act (YJCA), was involved in a street race with Jason Daoust, 18, also from Chelmsford, last April 22.

After police attended the scene, Daoust pulled his vehicle over, but the young offender's vehicle kept going at a high rate of speed and struck a bicycle being driven by Patrick Herard, 16, also of Chelmsford.

Daoust pleaded guilty last week to one count of dangerous driving. He will be sentenced in May.

During an emotional sentencing hearing today (Wednesday), Justice Jean-Gilles Lebel said he reluctantly agreed to a joint submission the accused be placed under house arrest for six months. He is not allowed to leave his home accept to attend College Boreal, any job he might have or to attend for counselling and medical emergencies.

Because this incident resulted in a tragic death, Lebel said he had no problem imposing the maximum sentence of a 10-year driving prohibition against the accused.

Under the terms of his sentence, the accused must reside with his mother or father, who live at different addresses in Chelmsford, at all times when he's not in school or at work.

He must not also consume alcohol or non-prescription drugs and attend any counselling sesssions his probation officer might recommend.

He's also to not have any contact with the Herard family.
