Repeat sex offender receives two-year penitentiary term

A Sudbury man with a long history of sexually assaulting boys has been sent back to a federal penitentiary.

Gary Danuk, 46, pleaded guilty Wednesday to sexually assaulting an 11-year-old boy on March 29. Danuk was on probation for another sex crime against boys at the time of this incident. Danuk was convicted of sexually assaulting another boy in late November of 2002. He was sentenced to three years probation with numerous conditions, including abstaining from alcohol.

Justice Louise Gauthier of the Ontario Superior Court of Justice heard that in the latest incident Danuk admitted to rubbing and attempting to put his hand down his young victim?s pants.

Gauthier agreed to a joint submission Danuk serve a two-year penitentiary term on top of eight months he?s already spent in pre-trial custody.

Sending Danuk to a penitentiary will allow him to access many programs available for pedophiles, said Gauthier.
Defence counsel Richard Huneault said Danuk was a victim of sexual and emotional abuse as a child and he?s kept much of his history bottled up inside.

Like many other sex offenders, Danuk?s own childhood sexual abuse was never dealt with, said Huneault.

Court heard Danuk was sentenced to 21 months in prison in 1989 while living in Nova Scotia. He was convicted of sexually assaulting three boys between the ages of four and nine.

After serving that sentence, Danuk returned to Sudbury and in 1994, he was sentenced to three years in the penitentiary for another sexual assault against a young male.

Danuk?s plea of guilt saved his latest victim from having to testify, but a penitentiary term is warranted as society has to be protected from this man, said assistant Crown attorney Philip Zylberberg.
